DMCA takedown
A DMCA takedown is a formal notice sent under the Digital Millennium Copyright Act asking an online service to remove material that infringes your copyright. Complying services must remove it promptly to keep their safe harbour from liability.
The Digital Millennium Copyright Act of 1998 gave online services a safe harbour: a platform that hosts user uploads is not liable for infringing material as long as it removes that material promptly when properly notified. The DMCA takedown notice is the mechanism, and it is the reason YouTube, SoundCloud, Instagram and every distributor have a copyright complaint form.
A valid notice under 17 U.S.C. 512(c)(3) has required elements — identification of the work, identification of the infringing material and its location, your contact details, a statement of good faith belief, a statement under penalty of perjury that you are authorised to act, and a signature. Sending a knowingly false notice carries liability under 512(f), so the process is not costless to misuse.
The person on the receiving end can file a counter-notification. If they do, the service may restore the material after a statutory waiting period unless the complainant files a lawsuit. That is the point at which a takedown fight becomes a real legal matter rather than a form submission.
For an independent artist, DMCA takedowns come up in two directions. Outward, when someone reuploads your track or your beat without permission. Inward, when a distributor or platform pulls your release because of a sample, a Splice-derived claim that was misfiled, or a Content ID conflict.
The misunderstanding: confusing DMCA takedowns with Content ID. Content ID is YouTube's private, automated matching system that usually claims revenue rather than removing videos. A DMCA takedown is a legal notice with statutory consequences, including copyright strikes on the uploader's account.
