Work made for hire
A work made for hire is a work whose author, in law, is the employer or commissioning party rather than the person who created it. In the United States it arises either through employment or through a signed agreement covering one of nine statutory categories.
Work made for hire is one of the strongest provisions in US copyright law, because it does not transfer a copyright — it changes who counts as the author from the beginning. The creator never held it. There is no reversion, no termination right, nothing to get back later.
Under 17 U.S.C. 101 it arises in only two ways. Either the work was prepared by an employee within the scope of employment, or the work was specially ordered or commissioned, falls within one of nine listed categories, and both parties signed a written instrument saying it is a work made for hire. Sound recordings are notably not one of the nine listed categories, which is why the standard approach in music is a work-for-hire clause paired with a backup assignment of copyright — so that if the work-for-hire characterisation fails, the rights still transfer.
For an independent artist this shows up in ordinary places. A session guitarist tracking a solo, a vocalist on a feature, a producer selling a custom beat as a full buyout, an engineer hired to program drums. Without paperwork, a contributor who added original expression may be a co-author of the composition, and that has consequences years later when the song earns.
The misunderstanding I see most: "I paid them, so I own it." Payment alone does not transfer copyright in the United States. A signed writing does. Get it signed at the session, not when the placement offer arrives.
